希瓦博显然是在自由民主、宪政法治这个自由主义的框架中对施米特作善意解释的。施米特的宪政理论对战后德国重建民主法治的宪政“有用”,也是以这种善意解释为依据的。只有那些保证贯彻正当法治宪法原则的政党才有资格享受宪法保障的权利,否则宪法有权规定将之取缔。战后德国宪法(基本法)不允许纳粹党在新宪法框架下死灰复燃,运用的就是施米特的这一宪法主张。施米特在20世纪20年代末30年代初纳粹崛起之前主张扩大兴登堡总统的主权者权力,以挽救当时的魏玛共和国国家,如果说有积极意义的话,那是就可能预防左、右革命党破坏宪政而言的。施米特所说的主权者是指像兴登堡这样的民选总统,国家元首是代表国家的人,他的最高责任是“维持(国家)稳定和保障(人民的)生命安全”。29按照施米特的说法,主权者在普通的情况下并不破坏正常的法治秩序,也不侵犯人民的私生活领域。30这样的主权者在平时并不见得有什么作用,但在“紧急”或“例外”情况下就显得作用特别重大,因为只有他才有权力决断国家是否进入“例外”状态,是否需要中止正常状态中的宪法,而且在危机过去之后,决断恢复正常宪政状态。[2]
